Terms of Service

Last updated October 6, 2026

These terms are an agreement between you and Signotech LLC (“Gosto”, “we”, “us”) and govern your use of Gosto, the website at gosto.ai and the service for building and running AI agents (the “Service”). By creating an account or using the Service you accept them. If you use the Service for a business, you accept them on its behalf and confirm you are authorised to do so; “you” then means that business.

1. The Service

Gosto lets you create AI agents that answer your customers on a website chat, on WhatsApp and by phone, and a shared inbox where your team can follow and take over those conversations. We may change, add or remove features over time. If we remove a feature you rely on in a paid plan, we will tell you in advance where reasonable.

2. Accounts

  • You must be at least 18 and able to form a binding contract.
  • Keep your sign-in email and Google account secure. You are responsible for what happens under your account and for the members you invite to your business.
  • Give us accurate information and tell us about any unauthorised use at contact@gosto.ai.

3. Your responsibilities for your agents

You decide what your agents say and who they talk to, so you are responsible for how they are used. In particular, you agree to:

  • comply with all laws that apply to your communications, including consumer protection, privacy, anti-spam and telemarketing laws (for example the TCPA in the United States);
  • get any consent the law requires before messaging or calling people, and honour opt-out requests;
  • tell people they are talking to an AI where the law requires it, for example California’s bot disclosure law, and get consent to record or transcribe calls where required;
  • give your customers a privacy notice that covers your use of Gosto;
  • check the accuracy of the knowledge, prices and offers you give your agents, and review what they tell customers.

4. WhatsApp and other third-party services

Some channels are provided by third parties, such as Meta (WhatsApp), Telnyx and ElevenLabs (phone), and Stripe (payments). When you connect one, you also agree to that provider’s terms. For WhatsApp this includes the WhatsApp Business Terms of Service, WhatsApp Business Messaging Policy and WhatsApp Commerce Policy. You authorise Gosto to access your WhatsApp Business Account to send and receive messages on your behalf. Meta’s own charges for conversations, if any, are yours. We are not responsible for third-party services, their availability, or their decisions to restrict or ban your account.

Using WhatsApp through Gosto

  • You must comply with the WhatsApp Business Messaging Policy at all times. In particular, you must get people’s opt-in before messaging them on WhatsApp, use approved message templates to start conversations or to message outside the 24-hour customer service window, honour requests to stop, and never send content the policy prohibits.
  • Meta may review, limit, suspend or ban your WhatsApp Business Account or phone number at its own discretion. We do not control those decisions and are not liable for them or for any loss they cause, including when you can no longer message your customers.
  • Messages and other data we receive through the WhatsApp Business API are used only to provide, secure and support the Service for you. We do not sell them, share them with data brokers, or use them for advertising or profiling. We do not use them to train AI models, and we only send them to AI model providers that do not store or train on them.
  • When you disconnect WhatsApp from an agent, or your account or business ends, we stop receiving your WhatsApp messages and delete your access token and the related WhatsApp conversations and the customer data that came with them, unless the law requires us to keep them. Deleted data leaves our live systems straight away and our backups within 30 days. Before you disconnect, you can download a copy of those conversations from the agent’s WhatsApp channel, or ask us for one at contact@gosto.ai.

5. Acceptable use

You may not use the Service to:

  • send spam, unsolicited bulk messages or robocalls;
  • deceive people, impersonate anyone, or run scams, phishing or fraud;
  • sell or promote illegal goods or services, or anything the applicable channel’s policies prohibit;
  • harass, threaten or discriminate against people, or collect sensitive data (such as health or financial account data) without a lawful basis;
  • ask for, collect or send payment card numbers, bank account credentials, government ID numbers or passwords through your agents;
  • infringe anyone’s intellectual property or privacy rights;
  • probe, disrupt or overload the Service, get around its limits or security, or reverse engineer it;
  • resell the Service or use it to build a competing product, unless we agree in writing.

Gosto is not designed to store or process regulated data, such as protected health information under HIPAA or cardholder data under PCI DSS. Do not use the Service for that data unless we agree in writing.

6. AI output

Agents generate answers with AI models, which can be wrong, incomplete or inappropriate. Output is not professional advice. You are responsible for how you use it and for configuring agents to hand conversations to a person where that matters. Output may not be unique, and others may receive similar output.

7. Your content and data

You keep all rights to the content you give the Service and to your customers’ conversations (“Your Content”). You give us a limited licence to host, process and transmit Your Content only to provide, secure and support the Service for you. We do not use Your Content to train AI models. We handle personal data as described in our Privacy Policy; for your customers’ data we act as your processor and follow your instructions. You confirm you have the rights and consents needed for us to do so.

Data processing

Where we process personal data for you as your processor, we:

  • process it only to provide the Service and on your documented instructions, which are these terms and how you set up the Service;
  • make sure the people who access it are bound by confidentiality;
  • keep appropriate technical and organisational security measures, as described in the Privacy Policy;
  • use subprocessors under written terms that protect the data at least as well as these terms. You authorise the subprocessors we use; the current list is available at contact@gosto.ai, and we will tell you before adding or replacing one so you can object;
  • help you answer requests from the people whose data it is, and with security, breach notification and data protection assessments where the law requires;
  • tell you without undue delay after becoming aware of a personal data breach affecting your data;
  • delete it when you delete it in the Service or when your account ends, unless the law requires us to keep it;
  • give you the information needed to show we meet these obligations.

If you need a separate data processing agreement, email contact@gosto.ai.

8. Plans, credits and billing

  • The Service is measured in credits. Each thing your agents do, such as a reply, a minute of a call or learning a page, uses credits in line with what it costs to run. Your usage is shown in Settings, Usage.
  • Paid plans are billed in advance through Stripe and renew automatically each month, or each year if you chose yearly billing, until cancelled. Each plan includes credits for each month, a yearly plan for each month of its year; credits a month does not use do not carry over. You can cancel at any time in Settings, Plan; cancellation takes effect at the end of the current period.
  • Credit packs are paid once. Their credits are used after a month’s included credits, do not expire while your account is open, and have no cash value. They cannot be transferred to another business.
  • If you turn on automatic top-up, you authorise us to charge the card you saved with Stripe the price of the pack you chose each time your credits fall below the level you chose, up to three times a day, until you turn it off. If a payment is declined, automatic top-up turns off and we tell you.
  • When a business has no credits left, beyond a small allowance so conversations under way are not cut off, its agents stop answering until credits are added or, without a paid plan, a plan is chosen.
  • A phone number we provide for an agent is charged in credits each month you keep it. If the business has no credits for 14 days, the number is released and may not be recoverable; we tell you before.
  • Free plans and trials may be limited, changed or ended at any time.
  • Fees are exclusive of taxes, which you are responsible for. Except where the law requires otherwise, payments are non-refundable. If a credit pack’s payment is refunded or disputed, the credits it bought are removed from your balance. If a plan’s payment is disputed, the plan ends.
  • We may change prices with at least 30 days’ notice, effective from your next renewal or purchase.

9. Our property

The Service, its software, design and the Gosto brand belong to us and our licensors. These terms give you a right to use the Service, not ownership of it. If you send us feedback, we may use it without obligation to you.

10. Suspension and termination

You can stop using the Service and delete your business at any time. We may suspend or end your access if you breach these terms, fail to pay, create legal or security risk, or if a channel provider requires it; where reasonable we will give notice first. After termination we delete Your Content as described in the Privacy Policy. Sections that by their nature should survive termination will survive.

11. Disclaimers

The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise the Service will be uninterrupted, error-free, or that messages or calls will always be delivered.

12. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability arising out of these terms or the Service is limited to the amount you paid us in the 12 months before the claim, or US$100 if greater. These limits do not apply to your payment obligations or your indemnity below.

13. Indemnity

You will defend and indemnify us against claims, fines and costs arising from Your Content, your agents’ communications, your breach of these terms or of law, or your breach of a channel provider’s policies.

14. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The state and federal courts in Delaware have exclusive jurisdiction, except that either party may seek urgent relief in any competent court. Nothing here removes rights you have under mandatory consumer law where you live.

15. Changes to these terms

We may update these terms. We will post the new version here and, for material changes, notify you by email or in the app at least 15 days before they take effect. Continuing to use the Service after that means you accept them.

16. General

These terms and the Privacy Policy are the whole agreement between us about the Service. If a provision is unenforceable, the rest remains in force. Not enforcing a provision is not a waiver. You may not assign these terms without our consent; we may assign them as part of a merger or sale. Neither party is liable for delays caused by events beyond its reasonable control.

We send notices to the email address on your account, and you send them to contact@gosto.ai. You agree to receive these terms, notices and receipts electronically. You may not use the Service if you are located in a country, or are a person, subject to US sanctions. Features marked as beta or preview are provided as they are and may change or be removed.
